Comprehensive Evaluations |
Early On® Michigan requires the performance of a timely, comprehensive, multidisciplinary evaluation of each child, birth through age two, referred for evaluation, including assessment activities related to the child and the child’s family. The Department of Education assures that all public agencies responsible for evaluations and assessments use nondiscriminatory procedures. Tests and evaluation materials are administered in the child’s and parent’s native language or mode of communication, unless it is clearly not feasible to do so. All evaluation and assessment procedures and materials are selected and administered so as not to be racially or culturally discriminatory.

Eligibility Determination |
Effective July 1, 2010 the eligibility criteria for children to enter Early On® Michigan has changed. Infants/toddlers are eligible for Early On if they have an established condition and/or a developmental delay of 20 percent or more in one or more developmental domains or a score of one standard deviation below the mean.

Natural Environments |
The Individuals with Disabilities Education Act (IDEA) Part C requires that eligible children ages birth to 36 months receive services in the child’s natural environment to the maximum extent possible. Since 1989, IDEA Part C has required that early intervention take place in settings in which children without disabilities participate. In the 1991 amendments to IDEA Part C, Congress added the language of “natural environments” as part of the definition of early intervention services. Statute also states that the Individualized Family Service Plan (IFSP) must include how services will be provided in the child’s natural environment and, if not, a justification why they cannot be provided in the natural environment.

Parental Consent for Activities Concerning Eligibility Determination and the Receipt of Services |
The Individuals with Disabilities Education Act (IDEA) and Early On® Michigan requires that a local Part C entity obtain consent before an evaluation is administered to an infant and child. In addition, IDEA requires that a signature of a parent or legal guardian be obtained when an Individualized Family Service Plan (IFSP) is written and include each service to be rendered.

Procedural Safeguards |
The early intervention system under Part C provides parents with procedural safeguards related to their child’s early intervention record. Part C implementing regulations (34 CFR 303) require that each state adopt confidentiality procedures which meet the confidentiality requirements in Part B of the Individuals with Disabilities Education Act (IDEA). The Part B confidentiality requirements (34 CFR 300.560-300.576) incorporate by reference the regulations in 34 CFR Part 99 (Family Educational Rights and Privacy Act, otherwise known as FERPA).
The state of Michigan Part C State Plan incorporates Procedural Safeguard Standards which require local early intervention systems to establish and implement policies and procedures that ensure the confidentiality of personally identifiable information, consistent with federal Part C/Part B/FERPA requirements and Michigan Procedural Safeguard Standards.

Timely Services |

The Individuals with Disabilities Act (IDEA) Part C requires that all infants and toddlers suspected of having a developmental delay or an established condition and are referred, have an evaluation and assessment. The purpose of the evaluation and assessment is to understand the development of the child in the context of his or her natural environment. The evaluation must include information on the child’s level of functioning and need for early intervention in the following areas: (1) Cognitive; (2) Communication; (3) Social/emotional; (4) Adaptive (self-help); and (5) Physical (including vision, hearing, gross and fine motor).
