State Resources

The Part C regulations were released September 28, 2011 (see 76 Federal Register 60140). Readers are reminded that where there is a conflict between the state and federal regulation or when attempting to comply with both federal and state laws would create a conflict, state law (to include policy, procedures, definitions, or methods) should be deemed preempted by federal law. Therefore; federal regulations preempt state policies and guidance, including the Early On Michigan State Plan and Michigan Department of Education Reference Bulletins. Where conflicts do not exist between federal regulations and state publications the state guidance should be followed. Michigan is in the process of reviewing and updating related policy and guidance.
